Below is a cut and paste copy of an email received today from David Buckley, HOA Board Member (Owls Nest) and Director of Community Planning for Toll Bros regarding the outcome of the Zoom Meeting held April 3, 2026. The transcript of the Zoom meeting has been filed by the Facilities and Landscaping Committee.

Dear Homeowners,

On behalf of the Board and myself, I would like to sincerely apologize for the multiple and at times conflicting communications regarding this matter, as well as any confusion related to the interpretation of the governing documents and vendor quotations.

Upon further review, Section 3.2(d) of the Supplemental Declaration for Owls Nest contemplates circumstances in which a Homeowner fully encloses their backyard with fencing, thereby rendering the area inaccessible and impractical for maintenance by the Association’s landscaping vendor. However, as all fencing areas within the community currently have gates installed, these spaces are not fully enclosed and remain accessible. Accordingly, such areas fall within the scope of the Association’s lawn maintenance services.

There was also some confusion regarding the potential for additional costs associated with accessing these areas, which led to the prior communication referencing a $74 charge. After further clarification with our landscaping vendor, it has been confirmed that there is no quantifiable additional cost or surcharge required. The vendor’s original pricing has always included lawn maintenance for these rear yard areas without any additional expense to the Association.

We again extend our sincere apologies for the confusion and any frustration this situation may have caused. The Board is committed to improving communication and ensuring that matters of this nature are thoroughly reviewed and clearly conveyed moving forward.
